Mumbai: Gautam NavlakhaAn accused in the Elgar Parishad-Maoist link case is likely to walk out of Navi Mumbai’s Taloja Jail on Saturday after a special court in Mumbai issued a release memo to facilitate his month-long detention.
Special Court to try cases related to National Investigation Agency (NIA)NIA) released the release memo on Saturday around 2.15 pm.
Friday afternoon Supreme court had rejected the NIA’s application and ordered that Navlakha be placed under house arrest “without fail” within 24 hours.
The probe agency on Saturday submitted a compliance report to the special court regarding completion of formalities for the activist’s release, following which the court issued a release memorandum, which would later be forwarded to the jail authorities and the police commissioner of Navi Mumbai.
After his release from jail, Navlakha will be taken to the premises selected for his house arrest in Navi Mumbai.
The 70-year-old activist, who claims to be suffering from multiple ailments, has been in jail since April 2020 in connection with the 2017-18 case.
The Supreme Court had on November 10 allowed Navlakha to be placed under house arrest for a month with certain conditions and said that its order be implemented within 48 hours.
However, the NIA had earlier this week moved the apex court, stating that Navlakha, being an accused in a case involving threat to national security and integrity, did not deserve any additional immunity.
However, on Friday, the Supreme Court went ahead with its November 10 order to place the activist under house arrest.
The case against Navlakha pertains to alleged hate speeches.Elgar Parishad‘ conference held in Pune on December 31, 2017, which police claimed led to violence the next day near the Koregaon Bhima war memorial on the outskirts of the western Maharashtra city.
According to the Pune police, the event was organized by people associated with banned Naxalite groups.
The case, in which over a dozen activists and academics have been named as accused, was later handed over to the NIA.
