US Supreme Court clears way for lawmakers to get Donald Trump’s tax returns

Washington: The US Supreme Court approved the release on Tuesday Donald Trump’s tax return House of Representatives committee, handing the necklace to the Republican ex-president who called the Democratic-led panel’s request politically motivated.
the judges refused Trump31 emergency application to stay a lower court ruling that upheld the Ways and Means Committee’s request for its tax records as a justifiable part of the panel’s legislative work. None of the justices publicly disagreed with the decision.
The committee, which has sought six years of Trump’s tax records spanning from 2015 to 2020, will have little time to complete its work related to the returns before a Republican takeover of the House. Republicans won a narrow majority after the November 8 midterm elections and took control of the House – and the committee – in January.
The battle over his tax returns is one of several legal woes for Trump as he moves forward with another run for the presidency in 2024. Trump announced his candidacy last week.
Richard Neill, chairman of Ways and Means, said the Supreme Court’s action upholds the principle of congressional oversight.
“This rises above politics, and the committee will now conduct the oversight we have asked for over the last three and a half years,” Neill said in a statement.
A spokeswoman for Trump did not immediately respond to a request for comment.
Trump was the first president in four decades not to release his tax returns as he sought to keep secret the details of his assets and the activities of his real estate company, the Trump Organization.
The Ways and Means panel told the Supreme Court in a legal filing that siding with Trump would harm the constitutional right of the co-equal branch of government “by preventing Congress from completing any investigation involving the former president, when There were also allegations that the investigation was politically motivated.”
In its request, the panel invoked a federal law that gives its chairman the authority to request any individual’s tax returns from the Internal Revenue Service (IRS). House Democrats have said they need to see Trump’s tax returns to assess whether the IRS is properly auditing the president’s returns and whether new legislation is needed.
In its filing, the committee told the judges that the IRS policy “does not address what to do with respect to a president who, like former President Trump, owned hundreds of business entities that had unusually complex returns, aggressive Used tax avoidance strategies and reportedly had ongoing audits.”
Trump’s lawyers have said that the true purpose of the committee was to publicly expose his tax returns and unearth politically damaging information about Trump.
US District Judge Trevor McFadden, a Trump appointee, sided with Congress in December 2021 and challenged the committee’s request, finding that the committee holds broad jurisdiction over the former president’s tax returns.
The US Court of Appeals for the District of Columbia Circuit also ruled against Trump in August and declined to rehear in October.
Tuesday’s order nullifies an order issued by Chief Justice John Roberts on Nov. 1 that effectively halted the controversy and barred the panel from receiving Trump returns while the court considered moving forward. did.
Trump has growing legal concerns. US Attorney General Merrick Garland last week named a special counsel to oversee two investigations, including a criminal investigation related to the FBI’s seizure of government documents from Trump’s Florida home.
His real estate company is in the midst of a criminal trial in New York on charges of tax fraud. A trial date was set for the following year by the New York State Attorney General accusing Trump and his three adult children of fraudulently misappropriating company assets and their net worth. In addition, an investigation in Georgia is probing whether he interfered with the 2020 election results in that state.
